How Do I Apply for Immigrant Benefits

You start the self-petitioning process by completing and filing USCIS Form I-360 (Petition for Amerasian Widow(er) or Special Immigrant)
and make sure you include all supporting documentation. The Vermont Service Center receives self-petitions and they should be sent by certified return receipt mail or any other method that provides assurance that the package was received. Sending the completed form to any other USCIS office will only delay matters. Keep a copy of all documents you submit and the proof of mailing.

You can obtain the forms in person at a USCIS office or by calling 1-800-870-3676 or by requesting them through the mail. You will receive a Notice of Receipt or acknowledgement within a few weeks of mailing the application and fee.

You Can Have Legal Representation

You may choose to be represented by an attorney or accredited representative when you file for immigrant benefits and status. If you can't afford a lawyer you may be able to ask an attorney, an association of immigration lawyers, a state bar association, or a specially accredited organization to provide free or reduced cost assistance. Employees and volunteers at a battered women's shelter may be able to provide assistance. Their advice will likely be to remove yourself from the abusive situation before filing for immigrant benefits.

Representatives Must Be Authorized

Accredited representatives must work for a recognized organization to be eligible to represent you before USCIS and they have to file a form G-28. They may be authorized to practice before USCIS, the Immigration Courts or the Board of Immigration Appeals.

Abuse of immigrants, or anyone for that matter, is a crime in the U.S. Signs of spousal abuse may be evident to doctors, social workers, teachers or other professionals, who are required to report it to the police. You should launch your self-petitioning process before the police are involved, if possible. Battered women's shelters offer advice, support and guidance through these trying times.
