Learn the Basics of Obtaining a Fiance VisaIf you are engaged to someone who is not a US citizen, and plan to get married in the US, consider hiring a fiancé visa attorney.Steps to File a Fiancée Visa ApplicationIf your fiancée is not a citizen, and you intend to wed in the US, you must file a petition with the USCIS for your fiancée. This is USCIS Form I-129F. If the petition is approved, then you must start the process of obtaining a fiancé visa from the U.S. Embassy or consulate in your fiancée's country. There is a time issue. US fiancé visa status will be revoked after 90 days. Your marriage absolutely must occur within 90 days of the fiancé entering the US. Until the marriage your fiancé is a nonimmigrant, seeking to enter the US temporarily, and may not be given an extension of the 90-day entry period. Time is of the essence. What if the Marriage Does Not Occur? If the fiancé does not marry the person who filed the Form I-129F within 90 days, he or she must leave the United States. Even if the fiancé marries someone else, and that person is a US citizen, the alien still must leave the country. The fiancé visa application can only be filed once, so if the person does not meet the fiancé visa requirements, they must use a different means to enter the country again. What Happens After the Wedding?Once you are married, your fiancé should apply for permanent resident status, unless you intend not to remain in the US. The fiancée visa application gives your fiancé temporary conditional permanent resident status, for a two year time period. The fiancé visa allows your fiancé only one entrance to the United States. If he or she leaves the country, they will need a new visa to reenter.Continue to : Procedures for Filing a Fiancé Visa Application Related ArticlesB-1 and B-2 Visas: The Most Common Nonimmigrant VisasWhat is an H-1B Visa to the United States?
