B-1 and B-2 Visas: The Most Common Nonimmigrant Visas

If you would like permission to reside in the United States without immigrating, then grab a tourist or business visa application form. The most common visa that allows non-immigrants to enter the US is the "B" class, which is offered in two forms. The B-1 allows people to enter the country for business purposes while the B-2 is a tourist visa, permitting entrance for pleasure trips.

B-1 Visas

The B-1 visa allows people to enter the country for a maximum of three months for business purposes. To qualify applicants must no intention of moving from their overseas residence and must be visiting the United States temporarily for business reasons.
Limitations of B-1 Visas
Visitors who come to the US under a B-1 visa are under certain restrictions. They cannot work for US based employers, only foreign entities, and the work must relate to international trade. Some of the questions the consular office considers in the approval process include:
  • Can the work be done by a US worker?
  • Is the work normally created in the US?
  • Is the work controlled by a US company?
A "yes" answer to any of these questions will most probably result in denial of the application. Potential approved activities might include:
  • An employee of an American company who works in a foreign office, and needs to come to the states to consult with the company.
  • A foreign company's employee coming to the US to handle sales.
  • A foreign company coming to the US to perform research.
  • Interviewing in the US for a position that will be in the home country.
  • Attending seminars or workshops.
  • Coming to invest in the US or open an office in the US.
  • Servants of an employer temporarily visiting the US.
  • Certain airline employees who cannot get "E" visa.
  • Professional athletes coming for an international tournament.
  • Participating in a board meeting.
  • Coming to begin opening a US business.
Individuals who are participating in any of these activities will need to fill out a business visa application form.
